Welcome to Elevate Learning! These terms and conditions ("Terms") govern your use of the Elevate Learning website (the "Site") and your enrollment in any of our courses, including our specialized journalism courses (the "Courses"). By accessing the Site or enrolling in a Course, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or enroll in any Course.

Enrollment in a Course requires payment of the applicable fees. Elevate Learning reserves the right to change its fees at any time, but such changes will not affect Courses for which you have already enrolled. Payments are processed securely through our payment gateway. You are responsible for providing accurate payment information and ensuring that you have sufficient funds to cover the fees. In the event of a payment failure, your enrollment may be suspended or terminated.

Upon enrollment, you will be granted access to the Course content for the duration specified in the Course description. Elevate Learning reserves the right to modify or update the Course content at any time. While we strive to provide high-quality and accurate content, we do not warrant that the content will be error-free or suitable for all learners. You are responsible for using the Course content in a responsible and ethical manner, particularly in the context of journalism, ensuring adherence to journalistic standards and ethics.

5. Intellectual Property

All content on the Site and in the Courses, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, is the property of Elevate Learning or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, educational purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit the content without the prior written consent of Elevate Learning.

Specifically, regarding our journalism courses, any work you produce as part of assignments or projects remains your intellectual property. However, by submitting such work, you grant Elevate Learning a non-exclusive license to use, display, and promote the work for educational and marketing purposes, with proper attribution to you.

7. Disclaimers

The Site and Courses are provided on an "as is" and "as available" basis, without any warranties of any kind, express or implied. Elevate Learning disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Courses will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site and Courses is at your own risk.

Specifically, in the context of journalism courses, Elevate Learning does not guarantee employment or any specific career outcome upon completion of a Course. The skills and knowledge gained through our Courses are intended to enhance your qualifications, but your success will depend on your individual efforts, market conditions, and other factors beyond our control. We are not responsible for any errors or omissions in the Course content, or for any consequences arising from your reliance on such content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elevate Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site or Courses; (b) any conduct or content of any third party on the Site, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall Elevate Learning's aggregate liability for all claims relating to the Site and Courses exceed the amount you paid to Elevate Learning, if any, during the six (6) months prior to the claim.

You agree to indemnify, defend, and hold harmless Elevate Learning and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your access to or use of the Site or Courses, your violation of these Terms, or your violation of any rights of another person or entity.

10. Termination

Elevate Learning may terminate your access to the Site and Courses at any time, with or without cause, and with or without notice. Upon termination, your license to use the content will immediately cease, and you must cease all use of the Site and Courses. Sections 5, 7, 8, 9, and 11 shall survive any termination of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Elevate Learning is located, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction in which Elevate Learning is located. The decision of the arbitrator shall be final and binding on all parties.

12. Changes to Terms

Elevate Learning reserves the right to modify these Terms at any time. We will post any changes to the Terms on the Site, and the revised Terms will be effective immediately upon posting. Your continued use of the Site or enrollment in a Course after the posting of the revised Terms constitutes your acceptance of the changes. It is your responsibility to review the Terms periodically for updates.
